2. Service Description
BookYourPipeline.com provides done-for-you outbound email and lead generation services, including but not limited to:
- Done-for-You Outbound Email: We create and send personalized outbound email campaigns on your behalf.
- Lead Sourcing & Research: We identify and research potential hiring managers and decision-makers in your target market.
- Contact Enrichment: We enrich lead data with accurate email addresses and contact information.
- Domain & Inbox Management: We manage email domains, inboxes, and deliverability infrastructure.
- Deliverability Protection: We implement email warmup, rotation, and monitoring to maintain high deliverability rates.
- Email Sequences & Messaging: We create and manage multi-touch email sequences designed to generate conversations.
- Inbox Monitoring: We monitor and manage responses to outbound campaigns.
- Appointment Scheduling: We facilitate meeting booking and calendar coordination for qualified leads.
3. Client Responsibilities
As a client, you are responsible for:
- Accurate Information: Providing accurate agency information, including business name, contact details, and any required documentation.
- Legal Compliance: Complying with all applicable hiring, recruitment, and employment laws in your jurisdiction.
- Meeting Obligations: Honoring booked meetings and appointments that result from our outbound campaigns.
- Ethical Use: Not misusing leads or engaging in spam, harassment, or other unethical practices.
- Content Approval: Reviewing and approving email messaging, targeting, and campaign strategies before deployment.
4. Lead Data & Ownership
Lead Ownership: Leads sourced and provided to you through our services remain your property. You may use these leads in accordance with these terms and applicable laws.
Anonymized Data: BookYourPipeline.com may retain anonymized performance data (e.g., open rates, response rates, conversion metrics) for internal analytics and service improvement purposes. This data will not include personally identifiable information.
Data Sourcing: All lead data is sourced from publicly available information (LinkedIn, job postings, corporate websites). We do not purchase data from third-party brokers that require explicit consent.
5. Email Compliance
We are committed to compliance with email marketing regulations:
- We comply with the CAN-SPAM Act and other applicable email marketing laws and regulations.
- All emails include clear opt-out mechanisms and unsubscribe links.
- Client Approval Required: You must approve all email messaging and targeting before campaigns are deployed.
- You are responsible for ensuring that your use of our services complies with all applicable laws in your jurisdiction.
6. Payment Terms
- Subscription Model: Services are provided on a monthly recurring subscription basis unless otherwise agreed in writing.
- No Long-Term Contracts: Unless otherwise specified, subscriptions are month-to-month with no long-term commitment required.
- No Refunds: We do not provide refunds for completed outbound work or services already rendered. Refunds may be considered on a case-by-case basis for prepaid services not yet delivered.
- Late Payments: Late payments may result in suspension of services. Accounts more than 30 days overdue may be terminated.
- Price Changes: We reserve the right to modify pricing with 30 days' notice to existing clients.
7. Cancellation Policy
- Month-to-Month Subscription: Subscriptions operate on a month-to-month basis with no long-term commitment.
- Cancellation Notice: A 30-day written notice is required to cancel your subscription. Cancellation requests should be sent to support@bookyourpipeline.com.
- Service Termination: Access to services will be terminated at the end of your current billing cycle following the cancellation notice period.
- Ongoing Campaigns: Active campaigns may continue through the end of the billing cycle. You will retain access to all lead data and campaign reports.
8. Results Disclaimer
Performance Varies: Outbound email performance varies significantly by niche, market conditions, messaging, and other factors beyond our control.
No Guarantees: We do NOT guarantee:
- Specific placement or hiring outcomes
- Revenue generation or business growth
- Response rates or conversion metrics
- Meeting booking rates
What We Guarantee: We guarantee the quality of our system, execution, and process. We commit to:
- Professional campaign execution
- High deliverability standards
- Transparent reporting and communication
- Compliance with email regulations
9. Limitation of Liability
To the maximum extent permitted by law, BookYourPipeline.com is NOT responsible for:
- Lost Revenue: Any lost revenue, profits, or business opportunities resulting from the use or inability to use our services.
- Hiring Outcomes: The outcomes of hiring decisions, interviews, or placement processes.
- Client Misconduct: Damages resulting from client misuse of leads, violation of laws, or unethical practices.
- Third-Party Actions: Actions or decisions made by leads, hiring managers, or other third parties.
- Service Interruptions: Temporary service interruptions, technical issues, or maintenance downtime.
Our total liability for any claims arising from these terms or our services shall not exceed the amount paid by you in the twelve (12) months preceding the claim.
10. Confidentiality
Mutual Confidentiality: Both parties agree to maintain confidentiality regarding:
- Business strategies and processes
- Email sequences and messaging templates
- Campaign performance data and metrics
- Proprietary methodologies and techniques
Proprietary Information: Our processes, email sequences, and strategies are proprietary to BookYourPipeline.com and may not be shared, copied, or used outside of our service relationship without written permission.
Client Data: We will maintain the confidentiality of your agency information, lead data, and business details in accordance with our Privacy Policy.
11. Termination
We reserve the right to terminate or suspend your access to our services immediately, without notice, for:
- Violation of these Terms of Service
- Unlawful behavior or use of our services
- Abuse, harassment, or spam activities
- Non-payment or breach of payment obligations
- Any conduct that we determine, in our sole discretion, to be harmful to our business or other clients
Upon termination, your right to use our services will cease immediately. You remain responsible for all charges incurred up to the date of termination.
12. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions.
Any disputes arising from these terms or our services shall be resolved through binding arbitration or in the courts of Canada, as applicable.
